9th Circuit: Permanent resident can be deported for DUI with child in car

A split panel at the 9th U.S. Circuit Court of Appeals ruled Monday that driving drunk with a child in the car who was not wearing a seatbelt can be considered child abuse in immigration court, making the crime grounds for deportation.

Judge Jay Bybee of the 9th U.S. Circuit Court of Appeals ruled that a lawful permanent resident can be deported because a child endangerment conviction qualifies as child abuse.

A split panel at the 9th U.S. Circuit Court of Appeals ruled Monday that driving drunk with a child in the car who was not wearing a seatbelt can be considered child abuse in immigration court, making the crime grounds for deportation.

The judges noted other circuits have ruled differently on similar cases, setting up the possibility of an en banc rehearing or a U.S. Supreme Court battle.
