Circuit court rules indirect control can determine joint employment
An appellate panel has ruled that using indirect or reserved control to determine joint employment is lawful, upholding a 2015 decision that has been since overturned, restored, and overwritten by a proposed national labor board rule.
An appellate court has ruled indirect control can be considered when determining whether two companies are joint employers, even as the National Labor Relations Board accepts comments on a proposed rule saying just the opposite and adding another wrinkle to a three-year saga on the issue.
