US rules preempt state for truckers’ rest breaks

A 9th U.S. Circuit Court of Appeals panel ruled that requiring long haul truckers to follow state laws already covered by federal rules would unduly burden interstate commerce.

A federal agency can preempt California's meal and rest break laws for long haul truckers, a 9th U.S. Circuit Court of Appeals panel ruled Friday.

The ruling by the three-judge panel is a victory for the trucking industry, which in 2018 successfully asked the Federal Motor Carrier Safety Administration to rule that state law -- which requires more meal and rest breaks for the truckers -- was preempted by the federal government.
