Bill seeks stricter scrutiny of expert testimony in criminal cases

Sen. Scott Wiener, D-San Francisco, said SB 243 aims to prevent wrongful convictions by requiring judges to assess the credibility of the scientific methodology, logic and foundation upon which expert testimony is based before allowing experts to testify in criminal cases.

Expert testimony and forensic science used to obtain criminal convictions would have to face stricter scrutiny from trial courts under a proposed bill introduced in the Legislature.

Prosecutors are concerned it would mean endless retrials and ask why civil cases aren't included.
