Union officials checking employee emails is ruled to be unlawful

The officials from Operating Engineers Local Union 3, ALF-CIO are required to stop accessing the work emails of the employees, according to the Jan. 22 decision. The officials will also have to post notices saying they will stop surveilling emails of employees at workplaces of employees who belong to their bargaining unit.

Union officials who accessed the emails of three public employees by filing a California Public Records Act request were unlawfully surveilling the employees' conduct, and will also likely deter the employees from exercising their right to talk about the union with their coworkers, according to a decision by an administrative law judge on the California Public Employment Relations Board.
