State high court to clarify retaliation claim standard

The case that prompted the 9th Circuit to seek clarification involves a former employee at PPG Architectural Finishes Inc., a company that manufactures paints, stains, caulks and other products, and sells those products to retailers such as Home Depot, Menards and Lowe's.

The state Supreme Court has agreed to clarify the evidentiary standard that should be used to assess certain workplace retaliation claims, in response to a petition by the 9th U.S. Circuit Court of Appeals that said the lack of clarity "has caused no small amount of confusion to both state and federal courts."
