US justices pepper lawyers in California hot pursuit case
“I don’t know why anybody is arguing that there’s a difference between felony and misdemeanors and why we’re recognizing a categorical rule at all,” said Justice Sonia Sotomayor. “Why isn’t the better reading just that hot pursuit is a type of exigent circumstance that can, but does not always, justify warrantless entry, regardless of whether the underlying offense is a felony or a misdemeanor?”




The U.S. Supreme Court peppered attorneys for nearly 2 hours Wednesday with questions about whether a limited Fourth Amendment exception that allows officers in hot pursuit of felony suspects to enter their homes without a warrant should also categorically include people suspected of misdemeanors.
