Bank says firm breached ethics by sharing client info with its operating officer

The lawsuit says Kronick Moskovitz Tiedemann & Girard APC violated an ethical wall when it shared information about the bank it represented with the law firm’s chief operating officer, Rick Fowler, who is not an attorney. Fowler also sat on the bank’s board and owned its stock. He was also named in the complaint.

A Sacramento judge appeared skeptical of Golden Pacific Bancorp Inc.’s arguments in a breach of contract and professional negligence case against Kronick Moskovitz Tiedemann & Girard APC.

As part of a larger case, the bank was seeking summary adjudication that the firm violated rules of professional conduct. Superior Court Judge Shama H. Mesiwala rejected the motion in her tentative ruling on Thursday.
