9th Circuit to rehear Oakland’s tax claim against Wells Fargo

Last summer, an appellate panel upheld most of the decision by U.S. District Judge Edward M. Chen to deny the bank’s motion to dismiss and left open the possibility the city could get injunctive and declaratory relief.

The 9th U.S. Circuit Court of Appeals on Tuesday vacated an opinion allowing the city of Oakland to pursue a lawsuit against Wells Fargo & Co. alleging that its discriminatory lending practices cost the city property tax revenue.

Instead, the 9th Circuit will hold an en banc hearing to decide the matter, according to the order by Chief Judge Sidney R. Thomas. ...
