Appeals court upholds denial of class in lawsuit against See’s Candies

"Individual testimony would be necessary to show that See's consistently applied an unlawful practice, resulting in a trial that would 'devolve into a series of minitrials,'" wrote Justice Elwood Lui in the unanimous ruling.

A state appeals court has upheld denial of class certification in a lawsuit accusing See's Candies of not giving proper rest breaks to employees who worked long shifts.

There was evidence that at least some class members were offered a second meal period in accordance with state law, the 2nd District Court of Appeal found in its April 20 ruling.
