Pet owners, vets, SPCA sue over rules against telemedicine

Plaintiffs’ attorney Bruce Wagman of Riley Safer Holmes & Cancila LLP in San Francisco said, “Our goal is to increase access to veterinary care and the vehicle if you will, the avenue, is the First Amendment, because veterinarians have a right to speak to their patients and the right goes both ways. The regulations that are being challenged specifically impose an illegal prohibition on that speech.”

Veterinarians, pet owners and the San Francisco Society for the Prevention of Cruelty to Animals filed a federal challenge to the California Veterinary Medical Board's rules prohibiting telehealth veterinary services.

Filed in the Eastern District of California on Monday, the lawsuit argues the board is treating veterinary speech less favorably than speech related to human medicine.
