In rare move, judge says he likely won’t allow town to take over water system
If Superior Court Judge Donald Alvarez adopts his tentative opinion it would be the second time a state court judge has blocked a city from using eminent domain to acquire a water system following the passing of state legislation in 1992 that gave utilities the right to challenge whether the taking of a property is in the public’s interest.
