Defenders seek review of panel’s reinstatement of doctor’s opioid trial

U.S. District Judge Cormac J. Carney of the Central District of California dismissed defendant Dr. Jeffrey Olsen’s 34-count indictment with prejudice last October, saying the suspension of jury trials violated Olsen’s speedy trial rights. A 9th U.S. Circuit Court of Appeals panel reversed.

Federal defenders representing an Orange County doctor want the 9th U.S. Circuit Court of Appeals to rehear his case and determine whether the Central District of California truly could not have held a reasonably safe jury trial during the COVID-19 pandemic.
