Denying asylum before processing is unlawful, U.S. judge says

“Because Defendants’ turning back of asylum-seekers unlawfully withholds their duties under statute, it violates the process due to class members,” U.S. District Judge Cynthia A.Bashant wrote in her Thursday opinion.

A federal judge in San Diego ruled that a government policy to turn back asylum-seekers before they are processed at ports of entry along the U.S.-Mexico border is unlawful under the Fifth Amendment's Due Process Clause.
