Loopholes for refinery toxic emissions must end, judge says

Valley Air argued it had the authority to create exemptions for petroleum refineries not refining crude oil but still operating, and for refineries with a capacity of less than 40,000 barrels per day.

A judge in Fresno County ordered a San Joaquin Valley regulatory agency Wednesday to close illegal loopholes that had exempted oil refineries from monitoring toxic emissions near fenceline communities.
