Governor signs bills on sentence enhancement over DAs’ objections

“Rather than achieving the author’s intent to improve fairness in sentencing while retaining a judge’s authority to apply an enhancement to protect public safety, this bill contains conflicting language that only serves to strip power away from judges that are in the best position to fairly and accurately impose a just sentence,” Ventura County District Attorney Erik A. Nasarenko wrote to the governor.

Among the last bills of the year that Gov. Gavin Newsom signed were criminal law measures that will make changes to the dismissal of sentence enhancements by judges and redefine portions of the gang enhancement law.
