Circuit panel won’t revive dealers’ suit against German carmakers
The 9th U.S. Circuit Court of Appeals panel, responding to car dealers’ emphasis on investigations overseas, explained that alleged violations of European law arising from cars sold in Europe might not be actionable under American law relating to cars sold in the United States.




The 9th U.S. Circuit Court of Appeals refused Tuesday to revive lawsuits from car dealers alleging the five leading German auto manufacturers violated U.S. antitrust law by colluding to avoid competing on low emissions technology and fix the prices of steel.
The court pointed in an unsigned order to a lack of evidence about the alleged conspiracies and how the accusations could "just as easily suggest rational, legal business behavior."
