Judge dismisses CEQA lawsuit, clears way for proposed reservoir near Sacramento

Gov. Gavin Newsom signed SB 149 last year, which allows governors to certify some important projects to resolve environmental impact complaints.

A Yolo County judge has rejected a California Environmental Quality Act lawsuit attempting to block a proposed reservoir north of Sacramento. He also did so quickly -- something that has been a rarity in both CEQA and water litigation in the past -- in compliance with a recent state law.

Judge Samuel T. McAdam wrote planners had done sufficient environmental review and examined alternatives. He did not mention SB 149, a law Gov. Gavin Newsom signed last year that allows governors...
