Trial to determine whether LAUSD liable for student's brain injury

Seeking to avoid a cap on damages, plaintiffs allege that the student's injury was primarily caused by cracked pavement. Citing student eyewitnesses, the school district disagrees.

A lawsuit that seeks to hold the Los Angeles Unified School District liable for a student's traumatic brain injury is set to go to trial in October, nearly seven years after it was filed. Neither party disputes the nature of the injury, but they disagree on whether a state law capping damages is applicable to the case.
