Judge ready to disallow new Apple Watch data for next trial against Masimo
The hearing stems from a motion to strike that Apple's counsel filed in August. That motion claimed Masimo improperly served the defense a last minute, 160-page expert report that expanded beyond the analysis of blood oxygen features for the Series 6 and 7 Apple Watch models at the heart of the case.
A federal judge overseeing a retried trade secrets case Masimo Corp. filed against Apple Inc. over wristwatch pulse oximetry technology tentatively ruled Monday he would not allow a plaintiff expert to introduce data for newly released Apple watches that was not included in a 2022 report presented to a jury last year.
