Public nurses can prove they deserve overtime pay, 9th Circuit rules

San Francisco says nurses at municipal hospitals are exempt as professional employees, but the city and county's win in district court was remanded by the circuit panel.

Staff nurses who work at San Francisco city and county hospitals will get another chance to prove they deserve time-and-a-half pay for overtime work, a 9th U.S. Circuit Court of Appeals panel ruled Wednesday.

The decision is a reversal of Chief District Judge Richard Seeborg of San Francisco's summary judgment ruling against the nurses, who argue that the city is violating the Fair Labor Standards Act, or FLSA, by failing to pay more for overtime.
