US honey producers stung by dismissal of all RICO claims against importers

The claims of a conspiracy by importers, certifiers and packers of foreign honey failed the particularity requirement for fraud cases by not giving the "who, what, when, where and how," U.S. District Judge Daniel Calabretta wrote.

A federal judge dismissed with prejudice claims by three U.S. honey producers accusing several importers, certifiers and packers of engaging in a conspiracy to import, certify and sell fake honey from India, Thailand and Vietnam.

The omnibus motion to dismiss was granted on Sept. 13 by U.S. District Judge Daniel J. Calabretta of the Eastern District of California, who found the plaintiffs failed to allege sufficient facts to satisfy the particularity requirement under Federal Rule ...
