Class certification granted in dispute over Nestlé's sustainability labeling

Nestlé had argued that the plaintiff can't provide evidence of class wide deception or damages, making refunds unfeasible.

A federal judge granted class certification in a lawsuit that accuses Nestlé of misleading consumers about sourcing cocoa from plantations in Africa that allegedly use slave labor.

On Thursday, U.S. District Judge M. James Lorenz dismissed Nestlé's claims that the plaintiff lacked sufficient evidence to prove deception or damages resulting from purchases of chocolate products labeled as sustainably sourced.
