Judge again dismisses lawsuit seeking Chiquita Canyon closure

Judge Stephen I. Goorvitch found that Los Angeles County has discretion when it comes to addressing environmental problems at the landfill that falls outside the scope of judicial review.

For the second time this year, a Los Angeles County judge has dismissed a lawsuit by citizens aiming to close the Chiquita Canyon Landfill, this time without leave to amend.

"The court does not believe petitioner can state viable causes of action," Judge Stephen I. Goorvitch wrote in his ruling dated Sept. 30. "At heart, petitioner challenges the county's issuance of the 2017 conditional use permit authorizing the continued operation and expansion of the landfill...
