City largely denied summary judgment against utility in wildfire litigation

Judge Elihu M. Berle ruled that a jury must decide whether the Creek Fire was caused by a DWP power line or one owned by Edison.

A Los Angeles County judge largely denied a bid by the city of Los Angeles to exit litigation brought by plaintiffs claiming a 2017 wildfire was ignited by poorly maintained power lines.

Judge Elihu M. Berle denied the city's motion for summary judgment as to whether the fire was caused by a Department of Water and Power line known as the Adelanto-Toluca L1 Circuit, or ADL-TOL, or an Edison power line known as the Lopez circuit. Plaintiffs allege it was one or the other, or b...
