SB 940: Misleading, unclear, and in need of reform

SB 940 misrepresents certification, misuses terms like "independent," and needs clearer language and amendments.

I agree that SB 940 is a poor piece of legislation. ("ADR certification: Why 'unambitious' may be best," John Derrick, Daily Journal, Dec. 18.) It "certifies" no one, has no real standards, only a pledge to follow the CA Rules of Court, which is impossible for any non-affiliated mediator or arbitrator and is a misrepresentation at best.
