State Supreme Court rules hospitals not liable for limited fee disclosures in ER

Justice Goodwin H. Liu wrote for a unanimous court that they must prioritize patient care over price transparency concerns. The decision resolves an appellate court split.

The state Supreme Court, erring on the side of ensuring that emergency room patients are treated even if the cost is high, has ruled that a San Jose hospital cannot be sued for failing to take extra steps to disclose their fees.

The ruling by Justice Goodwin H. Liu resolved a split among lower courts and affirmed a 6th District Court of Appeal decision in favor of San Jose Healthcare System LP, also known as Regional Medical Center San Jose.
