Judge denies San Francisco's motion to dismiss homeless advocates' lawsuit
Last month, U.S. Magistrate Judge Donna M. Ryu dismissed most claims by the Coalition on Homelessness and several individual plaintiffs in the wake of a U.S. Supreme Court decision. But she has rejected the city's latest motion to dismiss the entire complaint.
A U.S. magistrate judge in Oakland has rejected a bid by the San Francisco city attorney's office to dismiss a lawsuit by homeless advocates, expressing annoyance with the city for again raising standing issues.
"This is unhelpful and wastes court resources," U.S. Magistrate Judge Donna M. Ryu wrote late Thursday. Coalition on Homelessness et al. v. City and County of San Francisco, 22-CV-05502 (N.D. Cal., filed Sept. 27, 2022).
