Attorneys falling into Gen AI traps despite warnings
In response to the California State Bar's guidance on the ethical use of Generative AI in legal pleadings, a California attorney was sanctioned $2,500 for submitting a motion that included fabricated case citations and quotations, highlighting the importance of verifying AI-generated content and ensuring compliance with Rule 11.





As 2023 came to a close, the California State Bar Board of Trustees issued guidance to California attorneys on ethical (if not obvious) issues arising from the use of Generative Artificial Intelligence to draft legal pleadings. The guidance reminded attorneys that the use of "non-human, non-lawyer" assistance is subject to the same ethical rules as any other activity.
