Case May Reduce Employers' Summary-Judgment Motions

Oncidi - The state Supreme Court again has parted company with the U.S. Supreme Court on vital issues involving workplace discrimination and harassment. In a unanimous decision, State Department of Health Services v. Superior Court (McGinnis), 2003 Cal.LEXIS 9111 (Cal. Nov. 24, 2003), the court held that employers are strictly liable for all acts of sexual harassment by a supervisor.
