Unless there is a conflict of interest between the insured and the insurance carrier, the rate limitations do not apply.
In 1988, California Civil Code Section 2860 took effect. Section 2860 enables insurance carriers to limit the rates that they will pay counsel defending an insured in certain circumstances. The section has been the subject of considerable debate since its enactment.
