A federal judge denied a motion to dismiss a class action brought by gay California state employees challenging their domestic partners' exclusion from a long-term care insurance program.
Last summer, U.S. District Judge Claudia Wilken denied a similar motion to dismiss the case as it relates to state employees with legal same-sex spouses.
