The Environmental Protection Agency's plan to clean San Joaquin Valley smog is based on obsolete data and must be revised, a 9th U.S. Circuit Court of Appeals panel held Friday.
The panel, voting 3-0, granted the Sierra Club's petition for review of the EPA plan and sent the matter back to the agency for a do-over. Sierra Club v. U.S. EPA, 2011 DJDAR 844.
