The scope of copyright protection in a work covering historical events was at the heart of one of Esbenshade's most notable cases.


At issue was a copyright infringement and contract dispute filed against his client, Warner Bros., in which the plaintiffs claimed damages of $40 million. Novak v. Warner Bros., 08-56957 (9th Cir. 2010).
