Insurer's Bad Behavior May Force It to Pay Attorney Fees
Focus Column - Litigation - By Kirk Pasich - A prevailing party in litigation is not entitled to recover attorney fees from its adversary except when recovery is "specifically provided for by statute" or by agreement between the parties. See California Code of Civil Procedure Section 1021. However, an insured may be entitled to recover attorney fees from an insurer that breaches its duties.
