9th Circuit Is Risky Forum for Advocates of Same-Sex Unions

Han - The 9th U.S. Circuit Court of Appeals is about to become the nation's first federal appellate court to address the constitutionality of the federal Defense of Marriage Act. The appeal to the 9th Circuit comes from Smelt v. County of Orange , SACV04-1042 (C.D. Cal. June 16, 2005), in which District Judge Gary L. Taylor of the Central District upheld the constitutionality of the act.
