With Recent Supreme Court Rulings, Era of States' Rights Is Over

Forum Column - By Michael Halley - The Supreme Court's recent decisions in Gonzales v. Raich , 2005 DJDAR 6530, authorizing federal prosecutions of Californians who use, pursuant to state law, marijuana for medicinal purposes, and Granholm v. Heald , 2005 DJDAR 5561, striking down Michigan and New York laws curtailing the direct importation of wine notwithstanding their 21st Amendment right to regulate alcohol importation, signal the end of an era.
