Lowenstein - The blocking of the California recall election by a three-judge panel of the 9th U.S. Circuit Court of Appeals in Southwest Voter Registration Education Project v. Shelley was an extremely irresponsible intrusion into a state's political system. The later reversal by an 11-member en banc panel mitigated, but by no means eliminated, the harm.
