Open-Space Measure Doesn't Violate Constitution, State Law

Curtin Jr. - The 1st District Court of Appeal recently upheld an open-space initiative labeled Measure D ("Citizens for Open Space Initiative Plan to Protect Agriculture and Open Space"), which the electorate of Alameda County adopted in November 2000 to reserve more land for agriculture and open space and less land for urban growth.
