Justices discuss state Supreme Court's Sargon decision at the Association of Business Trial Lawyers luncheon
The Northern California Chapter of the Association of Business Trial Lawyers featured a presentation by state Supreme Court Justice Carol Corrigan and 1st District Court of Appeal Justice Mark Simons to discuss the state high court's 2012 decision in Sargon Enterprises Inc. v. USC, which said trial court judges must act as gatekeepers and exclude expert testimony that is speculative and based on faulty logic. Simons said the decision would result in many more motions to exclude expert witness testimony in trial court. Corrigan said there would be more emphasis on experts defining the terms they identify as critical to their analysis and explaining the methodology behind their findings. — Emily Green
