'Farah' May Encourage Aliens To Present Claims for Asylum
Focus Column - Immigration Law - By Brian D. Lerner - In Farah v. Ashcroft, 2003 U.S.App.LEXIS 23239 (9th Cir. Nov. 14, 2003), a Somali alien whose asylum application had been denied challenged the immigration judge's credibility determination underlying his removal order. Even though the 9th Circuit did not reverse the decision denying asylum, it did reverse the permanent bar to future filings with immigration.
