Over the last 20 years or so, there have only been a very few times that landowners successfully sued a government agency for what's called a temporary regulatory taking.


One of those victories went to Krolikowski last year. He and his team won $6.8 million, plus $2.5 million in costs, fees and interest, for a San Juan Capistrano landowner. Scalzo Family Trust v. City of San Juan Capistrano, 06CC04179 (Orange Super. Ct., verdict June 2010)
