Proponents Push to Vacate Prop 8 Ruling

The proponents of Prop. 8 filed a motion to vacate former Northern District Chief Judge Vaughn R. Walker's ruling that the same-sex marriage ban was unconstitutional on the grounds that Walker should have recused himself because he is gay.

SAN FRANCISCO - The proponents of Proposition 8, which former Northern District Chief Judge Vaughn R. Walker struck down as unconstitutional in August, filed a motion Monday seeking to vacate Walker's ruling on the grounds that the judge should have recused himself from hearing the case because he is in a same-sex relationship.
