Prosecutorial misconduct is getting increased disapproval at the 9th U.S. Circuit Court of Appeals, and censure doesn't come much stronger than it did Tuesday as a three-judge panel blasted an assistant U.S. attorney in Arizona and his bosses.
The panel's order in a drug trafficking appeal amended its Jan. 12 opinion that called out by name Assistant U.S. Attorney Jerry R. Albert of Tucson.
