Theory of Juvenile-Death Case Should Apply to Minors' Sex Crimes

Forum Column - By Timothy Rote and Claudia Rosenbaum - In deciding that the Eighth Amendment's ban on cruel and unusual punishment prohibits the execution of people who committed crimes before the age of 18, the U.S. Supreme Court majority found that research and studies support the assumption that adolescents lack the requisite maturity and mental capacity (as do adults) to be eligible for the death penalty, and therefore should be treated differently than adults.
