U.S. Sentencing Guidelines Undermine the Constitution
Forum Column - By Chris Ford - In "To Earn Discretion, Judges Must Stop Being Politicians" (Forum, Jan. 21), Hirbod Rashidi argues that judges should avoid politicking from the bench. While this undoubtedly is true, Rashidi's further argument - that before Congress rightfully can repeal mandatory-minimum sentences, wayward judges must "earn" their discretion - is not.
