Originally, Bank of America and real estate lawyer Ernest L. Messner Jr. were on the same side, as co-administrators of a trust left behind by Messner's now-deceased father. But after Messner threatened to bring claims against BofA for improperly using the trust's assets, the once-cordial relationship turned adversarial.
