NuVasive faces new patent damages trial

Two medical technology companies are in line to return to the Southern District of California for a new damages trial after a federal appeals court struck down a $101.2 million verdict.

Two medical technology companies are in line to return to the Southern District of California for a new damages trial after a federal appeals court struck down a $101.2 million verdict.


The U.S. Court of Appeals for the Federal Circuit unanimously decided Monday that the large damages award won by Warsaw Orthopedic Inc. in 2011 against San Diego-based NuVasive Inc. improperly included lost profits.
