At oral argument in Birkenfeld v. City of Berkeley (1976) 17 Cal.3d 129, the state Supreme Court had given pretty clear signs that it was going to uphold rent control. So landlord organizations told their lobbyists to get to work, before any other city enacted rent control. They introduced AB3788, which the Assembly passed June 16, 1976 (coincidentally the same day that the Supreme Court issued its opinion in Birkenfeld). The Senate passed it on Aug. 30.
