A long-shot bid to force state Attorney General Jerry Brown to defend Proposition 8 in federal court met a quick demise at the California Supreme Court late Wednesday.
The legal action now shifts back to the 9th U.S. Circuit Court of Appeals, which will hear arguments in December on whether the initiative's ban on same-sex marriage is constitutional.
